1. Acceptance of Terms

By accessing or using the LoanKey website located at www.loankey.org (the "Site"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using or accessing the Site.

LoanKey ("we," "us," or "our") reserves the right to modify, amend, or replace these Terms at any time without prior notice. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

Age Requirement: You must be at least 18 years old and a resident of the United States to use this Site. By using LoanKey, you represent and warrant that you meet these eligibility requirements.

2. Description of Service

LoanKey is an independent editorial comparison platform that provides information about personal loan products offered by third-party lenders in the United States. We aggregate and display publicly available data including APR ranges, loan amounts, credit score requirements, and lender terms to help consumers compare options.

LoanKey does not originate, broker, process, underwrite, fund, or approve loans. We are not a lender or loan broker. We do not collect loan applications or make credit decisions. All loan applications are completed directly on the lender's website.

3. Use License

LoanKey grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. This license does not include the right to:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information obtained from the Site
  • Use the Site for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the Site
  • Use any automated means (including robots, scrapers, or spiders) to access, collect, or extract data from the Site without our express written permission
  • Frame, mirror, or otherwise incorporate any part of the Site into another website or service
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site

We reserve the right to terminate or suspend your access to the Site at any time, for any reason, without notice.

4. Intellectual Property Rights

All content on the Site — including text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software — is the property of LoanKey or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

The LoanKey name, logo, and all related marks are trademarks of LoanKey. You may not use any LoanKey trademark without our prior written consent. All third-party trademarks, service marks, and logos appearing on the Site are the property of their respective owners.

5. User Conduct & Prohibited Activities

You agree not to use the Site in any way that violates applicable federal, state, or local laws or regulations. Prohibited activities include, but are not limited to:

  • Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with any person or entity
  • Uploading, posting, or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Interfering with or disrupting the Site, servers, or networks connected to the Site
  • Attempting to probe, scan, or test the vulnerability of the Site or any associated system or network
  • Engaging in any activity that imposes an unreasonable or disproportionately large load on our infrastructure
  • Using the Site to transmit spam, chain letters, or other unsolicited commercial communications

7. Disclaimer of Warranties

THE SITE AND ALL INFORMATION, CONTENT, MATERIALS, AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE ARE PROVIDED BY LOANKEY ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING.

LOANKEY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR THE INFORMATION, CONTENT, MATERIALS, OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SITE IS AT YOUR SOLE RISK.

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, LOANKEY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

LOANKEY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LOANKEY AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY INFORMATION CONTAINED THEREIN.

IN NO EVENT SHALL LOANKEY'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED ONE HUNDRED UNITED STATES DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Indemnification

You agree to indemnify, defend, and hold harmless LoanKey and its owners, employees, contractors, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including any copyright, trademark, trade secret, or privacy right; or (d) any claim that your use of the Site caused damage to a third party.

10. Governing Law & Dispute Resolution

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the United States and the state in which LoanKey operates, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved exclusively through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in a mutually agreed location within the United States, and judgment on the award may be entered in any court having jurisdiction.

You agree that any claim against LoanKey must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

11. Termination

LoanKey reserves the right, in its sole discretion, to terminate or suspend your access to all or part of the Site at any time, for any reason or no reason, with or without notice. Upon termination, your right to use the Site will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to reflect the parties' original intent as closely as possible while remaining enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and LoanKey with respect to your use of the Site and supersede all prior or contemporaneous communications and proposals, whether oral, written, or electronic, between you and LoanKey regarding the Site.
